The European Court of Human Rights (ECHR) condemned France for violating a woman's right to privacy after French courts ruled her refusal of sexual relations with her husband was grounds for divorce. Professor Rémy Libchaber questions the condemnation, stating that "marital duty" has no bearing on French law. The ECHR found the French court's emphasis on "marital duty" disregarded the necessity of consent in sexual relations, constituting unacceptable interference in the woman's sexual freedom.
